1. Which bonus programs are the most popular?
Miles & More is Europe's largest frequent flyer and rewards program. At least that's what Lufthansa, which is behind Miles & More, claims. The competition on the railways is holding back with its Bahn Bonus Program Service.
With Miles & More and the Bahn Bonus Program, it does not matter whether your trips are limited to Germany or whether you are traveling all over the world on business. Long distances are even an advantage, as long travel times also result in more airline miles with Miles & More and more rail bonus program points.
But can you redeem the Bahn Bonus points and use the Miles & More miles privately?
The rail bonus program
After registering for the Deutsche Bahn bonus program free of charge, customers receive points every time they buy a ticket. The first 250 Bahn Bonus Program points are already available as a welcome gift. You can redeem the Bahn Bonus Points as soon as a minimum number has been reached. For example, for 250 points there is a 5 euro voucher for the dining car of the Deutsche Bahn. With 500 Bahn Bonus Program points, you can upgrade to first class. Similar to Miles & More, the Bahn Bonus Program offers members a wide range of rewards for which they can redeem their Bahn Bonus points.
If you want to redeem your Bahn Bonus Program points, you can choose between upgrades, tickets and rewards such as a cookbook or a Bluetooth music box.
In order to be able to redeem the Bahn Bonus Program points, all you have to do is select your desired product, pay with the Bahn Bonus Program points and you will receive your bonus in the mail.
As with Miles & More, you can also use the bonus points with partner companies with the Bahn Bonus Program. The Bahn Bonus Program also applies, for example, when booking a rental car with Europcar. This is not only about collecting the Bahn Bonus Program points via the car rental company, but you can also redeem the Bahn Bonus points there directly. In addition to the rental car companies, a number of hotel chains also offer cooperation with the Bahn Bonus Program. This means that you can redeem your train bonus points directly at the hotel and, for example, spend the night more cheaply.
When you redeem your Bahn Bonus Points, the desired reward will be at your home within 10 days. However, if you want to redeem your Bahn Bonus points to book an online ticket, you will receive a confirmation by email immediately after making your selection. For every EUR 1 spent on tickets, you will receive one bonus point on your Bahn Bonus Program account and one Bahn Bonus Program Comfort point. You can also track your Bahn Bonus Program points balance in the app. However, you must redeem Bahn Bonus points on the Deutsche Bahn homepage.

Miles & More
Lufthansa's Miles & More program works on the same principle as the rail bonus program, only in the air. Here, too, frequent flyers are rewarded for traveling with Lufthansa or with their "allies". After registering with Miles & More free of charge, customers receive bonus miles for every flight, which can be exchanged for rewards such as free flights or a free change from economy to business class. You can also have flight miles credited to your Miles & More account at a later date. Normally, the miles are automatically transferred to the Miles & More account as soon as you have used the service. However, this automatic credit can take up to 7 days. If you want to submit your miles at a later date, you should wait for this period of 7 days. A subsequent credit must be submitted within the following 6 months. After this deadline, the miles will no longer be transferred to your Miles & More account.
In addition to the Miles & More app or the website, you can also convert your miles into an upgrade directly at the airport. Simply go to the check-in counter and have your Miles & More membership card or your frequent flyer number ready when you check in. It is very important that you know your Miles & More PIN if you want to book the upgrade at the counter.

But can you redeem Bahn Bonus points that you have collected for your job or simply use Miles & More miles for private purposes?
2. Who do the Miles & More points and the Bahn Bonus Program belong to?
The question of who is entitled to the Miles & More or Bahn Bonus Program award entitlements that have been collected professionally has repeatedly been disputed. The first fundamental judgment of the Federal Labor Court, which is still valid in 2018, dates from 2006 (BAG, judgment of April 11, 2006, 9 AZR 500/05). The court ruled at the time that Miles & More award points are due to the employer if the employer has paid for the flight tickets.
The highest German labor court argued at the time with reference to Section 667 of the German Civil Code (BGB). This states that the agent, i.e. the employee, is obliged to give the employer everything he has obtained in the course of an agency. If the employee earns miles through the business trip, they are not allowed to transfer them to their private Miles & More account. This principle about Miles & More also applies to other bonus systems such as the Deutsche Bahn Bahn Bonus Program. From a legal point of view, you are therefore not allowed to simply redeem the Bahn bonus points.
If you want to redeem your Miles & More miles or train bonus points, you should find out beforehand how this is handled in your company. You can also read whether your contract contains provisions on Miles & More, the Bahn Bonus Program and Co.
3. Contractual regulations and company agreements for Miles & More and the Bahn Bonus Program
If you have agreed with your employer that you are personally entitled to the Bahn Bonus Program points that you have collected professionally, then you can redeem the Bahn Bonus points at your own discretion. There is also the option of sharing the Bahn Bonus Program points or for the miles to be transferred to two separate Miles & More accounts. However, the employer may not unilaterally change a contractual agreement on the Miles & More and Bahn Bonus Program once it has been made. If he does not allow you to redeem Miles & More miles or your Bahn Bonus points, you will have to cancel the change, which is almost always illegal.
In large companies, questions about Miles & More and who can redeem the Bahn Bonus points are usually clarified within the framework of company agreements. If there is an agreement that allows the employee to redeem the Bahn Bonus points, or to assign Miles & More points to them, then the rewards can also be used for private purposes without hesitation. However, it is better to get in touch with your employer before you start your journey and check the contractual status of Miles & More and the Bahn Bonus Program.

Often the employer simply accepts that his employees redeem Miles & More miles or train bonus points and use them for private purposes. In the opinion of the court, it is necessary for the development of a company practice that the employer tolerates private use of the Bahn Bonus Program or Miles & More awards over a period of several years.
If this is the case, the employees have an actionable legal right to redeem their professionally acquired Miles & More and Bahn bonus points and use them for themselves and their families.
4. What are the consequences of misusing Miles & More and the Bahn Bonus Program?
You may only use professionally earned Miles & More and Bahn Bonus Program awards privately if this has been agreed or if there is a company practice that allows this procedure. In all other cases, you are committing a breach of labor law if you acquire awards from Miles & More or the Bahn Bonus Program on your own initiative.
This behavior justifies a termination at least after a previous warning. In addition, the employer can demand compensation if you unauthorized redeem the Bahn Bonus points or use the Miles & More miles. In individual cases, the criminal offense of embezzlement or embezzlement can also be fulfilled. If the private use of Miles & More or Bahn Bonus Program awards is expressly prohibited in your company, you should absolutely observe this provision. Instead of appropriating the Miles & More bonus points yourself, it is wiser to negotiate here for the next round of salaries. This means you can redeem your Bahn Bonus points or collect more miles on your Miles & More account on your next business trip
5. The free flight also makes the tax authorities happy
If your employer grants you the Miles & More or Bahn Bonus Program points that you have acquired professionally, this can represent a monetary benefit that must be taxed like your salary. An annual tax exemption of 1,080 euros applies. The excess amount from Miles & More and the Bahn Bonus Program is subject to wage tax. However, the tax is only due if you actually claim a bonus from the Bahn Bonus Program or your Miles & More account. You are therefore obliged to inform your employer when you redeem the Bahn Bonus points or use your Miles & More miles. The employer then withholds the wage tax applicable to the Miles & More and Bahn Bonus Program awards.
